Court Rules California County Can’t Sue Drug Makers

 

The U.S. Supreme Court ruled Tuesday that a California county can’t sue large pharmaceutical companies on allegations that they overcharged public health-care facilities for prescription drugs.  The high court, in a unanimous opinion by Justice Ruth Bader Ginsburg, said California’s Santa Clara County did not have a legal right to bring the lawsuit. At issue were drug makers’ pricing obligations to health-care facilities that serve the poor, and whether those facilities have a right to sue drug companies to enforce those obligations.
